After Hours Policies

BORROWING POLICIES

Books and materials may be borrowed from the Law Library in accordance with the following rules adopted by the Board of Trustees:

  1. Persons and institutions who may borrow materials are:

    1. Attorney Borrower: Any member in good standing of the State Bar of California, who resides in, or has a law office in, Santa Cruz County, and out-of-county attorneys who are in trial here.
    2. Judicial Borrower: Any judge, commissioner or referee of a Santa Cruz County court.

    3. Resident Borrower: Any resident of Santa Cruz County, or any non-resident who is a pro per litigant within the county
    4. Government Borrower: Any person who is employed by the County of Santa Cruz.

    5. Library Borrower: Libraries may borrow materials in accordance with the provisions of the inter-library loan policies established by the American Libraries Association and other national and international agreements.

  2. Messengers. A Borrower may obtain books or materials by employing a messenger or messenger service authorized in writing by the Borrower to take possession of the books or materials.

  3. Loan Period. Books and materials may be borrowed for a period of 7 calendar days. Reserve and reference books may circulate overnight, which is from 4 p.m. until 10 a.m. the next business day.

    1. Renewals. 7-day books and materials may be renewed for one additional loan period either in person or by telephone, unless the material has been requested by another patron. Books designated "reserve" or "reference" may not be renewed.

    2. Reserving materials. For material already in circulation, a patron should request a "hold" and complete a charge card in order to be notified when the material is returned to the library.

  4. Books and Materials Loaned. Digests, indexes, and citators do not circulate. Selected "reserve" and "reference" books may circulate overnight . No borrower may have a quantity of books or materials at any one time that appears in the judgement of the Law Librarian to be excessive. Books and materials ordinarily subject to borrowing may be withdrawn from borrowing privileges under condition and for periods determined by the Law Librarian.

    MATERIALS NOT READILY REPLACEABLE MAY NOT BE LOANED TO A RESIDENT OR LIBRARY BORROWER.

  5. Fines, Charges and Deposits.

    1. Fines. Reserve and reference books, five dollars ($5) per day; audio tapes are fifty cents ($.50) per day; all other books, twenty-five cents ($.25) per day, provided that no fine shall exceed the replacement cost of the book or materials, plus five dollars ($5). If the overdue period exceeds 30 days, the book or materials shall be deemed lost.

    2. Charges. All borrowers shall be charged for the replacement cost or the value of the book or material lost, plus five dollars. A book or item substantially damaged or defaced shall also be deemed lost, unless it may be suitably repaired, in which case a charge equal to the cost of making such repairs shall be made against the borrower.

      There is a borrower's fee of ten-dollars ($10) per title for MCLE self-study tapes.
    3. Deposits. Resident Borrowers must post a security deposit equal to the cash value of each book borrowed plus five dollars (5$) per book.

  6. Payment of Fines and Charges. Resident Borrower fines and charges are deducted from the cash deposit. All other fines and charges are due and payable upon receipt of written notice to the borrower. Unless the borrower pays the amount due within 30 days of the mailing of the notice, the right to borrow books or materials shall be suspended. Privileges shall be reinstated upon payment of the amount due.

  7. Suspensions and Terminations.

    1. Borrowing privileges cease when a borrower no longer qualifies under Rule 1.

    2. A borrower who flagrantly or persistently violates the borrowing rules shall have his/her borrowing privileges suspended or terminated by the Board of Law Library Trustees. If a borrowers' privileges are suspended or terminated, he/she may not qualify as another type of borrower until suspension or termination has been rescinded.

INTERNET ACCESS POLICY


PURPOSE:
Legal Research Only. Library Staff reserves the right to define what is non-legal research and has the authority to revoke use. This policy is to be an operating policy subject to modificatioin and revisions by the staff and Board of Trustees.
ACCESS:
Sign in at a terminal for thirty (30) minutes use in any four (4) hour period during regular business hours.

Users must be at least eighteen (18) years of age or have prior approval from library staff. Proof of age may be required.

Self-serve: Library staff does not provide individual instruction, research assistance, or verify or interpret database information.

TECHNICAL INFORMATION:

The World Wide Web is made available through the Mozilla browser.

E-mail is available for persons on library, court,or county government business.

Deleting or modifying computer settings, removing or adding desktop folders, or downloading to the hard drive is strictly forbidden.

PRINTING:

Printers are not available for internet data or E-mail. Informatioin may be downloaded to a diskette (availalbe for purchase, $1), faxed, or e-mailed.

AFTER-HOURS ACCESS POLICY
  1. Access to the County Law Library outside of normal business hours may be granted to judges who reside in California and to attorneys who are:

    1. Active members of the California State Bar

      1. Who reside in this county.

      2. Who maintain an office in this county.

      3. Who are in trial here.

      4. Whose offices and homes are more distant from a facility of their own county law library than from ours.

    2. Members of an out-of-state bar granted leave to appear as counsel pro hac vice.

    The following additional persons may qualify for after-hours access privileges by appying to the Board of Law Library Trustees:

    1. Inactive members of the California State Bar who reside in this county;

    2. Litigants appearing in propria persona who reside in this county, who require the use of materials not readily available elsewhere, and who are unable to use the law library during regular business hours;

    3. Law school students, paralegal program students, and law school graduates who reside in this county, who require materials not readily available elsewhere for a particular class or project, and who are unable to use the law library during regular business hours;

    4. Research assistants who reside in this county, who are employed by attorneys, public agencies or legal departments of businesses, who are unable to use the law library during regular business hours.

    Cardkey privileges for categories i through iv above expire upon conclusion of the litigation, class, project, or employment for which the application is made, or at the end of one year, whichever occurs first.
  2. Cardkeys may be purchased from the Law Librarian. Renewal notices for active State Bar members are mailed in December. (Refer to attached fee schedule.)

    1. Cardkeys issued to active members of the State Bar automatically expire on the second Monday in February. Cardkeys renewed after that date are subject to a reinstatement charge.

    2. The person to whom a cardkey is issued is:

      1. Not permitted to admit anyone to the building or Law Library but him/herself without prior approval from the Law Librarian or the Board. Handicap users who may require special assistance are excluded from this provision.

      2. Not permitted to lend the cardkey to anyone.

    3. Violation of any of the conditions in Section II will be cause for immediate suspension of after-hours access privileges, pending a final decision by the Board of Law Library Trustees at its next regularly scheduled meeting. The Board of Law Library Trustees may impose other sanctions at its discretion.

    4. Anyone in the Law Library after regular business hours is required to show the cardkey upon request.

    5. The Board may suspend cardkey privileges of users who flagrantly abuse library policies or who have past-due accounts.

    Each after-hours user shall pay a $10 fee to purchase a cardkey or to replace a lost or stolen cardkey.
    All use fees are for twelve (12) months unles otherwise indicated.

    Student Fees may be prorated by the quarter or semester.

    Qualified persons from catagories I through IV above may, as an option to the basic fee, rent a card on a daily basis.
    This provision shall extend only to individuals who desire after-hours access fewer than five (5) days per year.

    All other fees determined upon application to the Board of Law Library Trustees.

    Application for After-Hours Access

    Any person aggrieved or any person adversely affected by any of these policies
    or by any determination of the Law Librarian may appeal to the Board of Law Library Trustees.
